Service Delivery and Refund Policy

This policy applies to digital services provided by MAREA INCARCARE S.R.L. (commercial brand: e-Chantier) through the e-chantier.com website and the e-Chantier SaaS platform. It covers subscription access, onboarding and related support services.

e-Chantier is a digital service (SaaS) delivered electronically. There is no physical shipment of goods. Access is granted by activating a company account and user credentials after registration approval and, where applicable, payment confirmation.

• Self-service plans: after successful payment (card via Stripe), access is activated automatically, usually within minutes.
• Plans with manual approval: activation within a maximum of 2 business days from payment confirmation or contract signing.
• Onboarding assistance: if included in the plan, scheduling takes place within 5 business days of the request.
• Login credentials are sent to the email address provided at registration or shown in the app after activation.

Under GEO 34/2014 on consumer rights, for digital content not supplied on a tangible medium, performance begins after your express prior consent and acknowledgement that you thereby lose the statutory withdrawal right where applicable (Art. 16 lit. m).

For B2B contracts (legal entities), access is deemed delivered when the administrator account is activated.

If you are a consumer (natural person acting outside your trade/profession), you have a 14 calendar day right of withdrawal from the distance contract, without giving reasons, under GEO 34/2014.

• The period starts on the day the contract is concluded.
• If you requested immediate activation of the digital service before the 14 days expire and acknowledged loss of withdrawal right, the right no longer applies to the portion already performed.
• To exercise withdrawal, send a clear statement to [email protected] or via in-app support.

B2B clients (companies) are not covered by the consumer withdrawal right unless expressly agreed in writing.

• Within 14 days (consumers): if withdrawal is valid and the service was not fully performed with your prior consent, we refund amounts paid within 14 days of receiving the withdrawal notice, using the same payment method where possible.
• Monthly subscriptions: no refund for the current billing month after activation, except where required by law or in case of proven technical unavailability attributable to us for more than 72 consecutive hours.
• Annual subscriptions: proportional refund of unused full months may be granted on a case-by-case basis if cancellation is requested in writing within 14 days of purchase and the account was not materially used (no payroll/site data entered).
• Chargebacks: unjustified chargebacks may lead to account suspension pending clarification.

Complaints regarding delivery or billing are handled within a maximum of 30 calendar days from receipt, per usual Romanian practice and ANPC recommendations for digital services.
